Terms of Service
Effective September 4, 2026
These Terms govern your use of onitdata.com and services provided by XAE LLC, doing business as OnIT Data Systems (“OnIT”). By using a service, you agree to these Terms and our Privacy Policy. A separate written agreement controls if it conflicts with these Terms.
Accounts and acceptable use
You must provide accurate information, protect your account, and use the services only for lawful purposes. You may not interfere with service operation, attempt unauthorized access, misuse another person’s information, transmit harmful code, or use the services to violate law or third-party rights.
SMS authentication terms
When you enter a mobile number and request a code in an OnIT phone sign-in or registration flow, you expressly consent to receive an automated one-time authentication text from OnIT Data Systems at that number. Consent is limited to authentication and is not a condition of purchasing services. Message frequency varies with your requests. Message and data rates may apply.
Reply STOP to opt out or HELP for help. You may also contact hello@onitdata.com or 248.221.2421. Carriers are not liable for delayed or undelivered messages. Delivery is not guaranteed. See our Privacy Policy for information about mobile data.
Service availability and changes
We may update, suspend, or discontinue features and may take reasonable action to protect users or the service. We do not promise uninterrupted or error-free operation. Beta or preview features may change and should not be used where failure could cause material harm without suitable safeguards.
Your content
You retain rights in content you provide. You grant OnIT the limited rights needed to host, process, transmit, back up, and display that content to provide the service according to your instructions and applicable permissions. You are responsible for having the rights and authority necessary to provide it.
Intellectual property
OnIT and its licensors retain rights in the services, software, designs, and related materials, excluding your content. These Terms do not grant rights to use our names, marks, or content except as necessary to use the services.
Disclaimers and liability
To the extent permitted by law, services are provided “as is” and “as available.” OnIT disclaims implied warranties. OnIT will not be liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, revenues, data, or goodwill. Any liability will be limited to amounts paid for the affected service during the 12 months before the event giving rise to the claim, unless applicable law prohibits that limitation.
Termination
You may stop using the services at any time. We may suspend or terminate access for material breach, legal requirements, nonpayment, or threats to service security or integrity. Provisions that by their nature should survive will survive termination.
Governing law and changes
Michigan law governs these Terms, without regard to conflict-of-law rules. Courts with jurisdiction in Michigan will have exclusive jurisdiction unless a separate written agreement states otherwise. We may update these Terms and will post the updated version with a new effective date.
